§ 1 Scope of application
(1) The stadium regulations apply to the enclosed area of the municipal stadium on Hamburger Straße ("Eintracht Stadium") and the areas and facilities marked on the site plan (hereinafter uniformly referred to as the stadium site). The area of application is marked on the attached site plan (Annex 1), which is part of the stadium regulations. (2) The stadium regulations apply in principle to all events that take place in the stadium.
§ 2 Dedication
The stadium regulations serve to regulate the use and ensure safety and order in the area of the municipal stadium on Hamburger Straße, including its facilities, the entrances and exits to the stadium and the adjacent parking areas that are available for use by visitors during events in the stadium. (2) The stadium is primarily used to host sporting events of all kinds. (3) In addition to sporting events, other major events (e.g. concerts, meetings) of a supra-regional or representative nature may be held in the stadium. The operator shall decide on admission. (4) The general public is only entitled to access and use the stadium and its facilities within the scope of the aforementioned purpose and in accordance with these stadium regulations. (5) The contracts to be concluded in individual cases for the use of the stadium are governed by civil law
§ 3 Domestic authority
The City of Braunschweig exercises domiciliary rights. It has transferred this right to Braunschweiger Veranstaltungsstätten GmbH (for the area of Annex 1). Braunschweiger Veranstaltungsstätten GmbHH may transfer domiciliary rights to the respective organizer and/or the security and stewarding service (SOD). They are entitled to issue instructions to visitors in accordance with these stadium regulations.
§ 4 Incoming goods inspection
(1) When entering the stadium grounds and during checks within the stadium, every visitor is obliged to show their admission ticket or authorization card to the security and stewarding service without being asked and to hand it over for inspection on request. This obligation also applies to the police upon request.
(2) The security and stewarding service is entitled to examine persons - also by using technical aids - to determine whether they pose a security risk, in particular due to alcohol or drug consumption or because they are carrying weapons or dangerous or flammable objects and items. The rights of the police to search persons and property on the basis of existing laws remain unaffected by this regulation.
(3) Persons who cannot provide proof of their right to stay and persons who pose a security risk must be turned back and prevented from entering the stadium grounds. The same applies to persons against whom a local or nationwide stadium ban has been issued. In this case, the organizer reserves the right to press criminal charges.
(4) If a visitor refuses to comply with the control according to paragraphs 1 to 3 or other orders of the security and stewarding service of the respective organizer, Braunschweiger Veranstaltungsstätten GmbH or BTSV Eintracht von 1895 e.V. or Eintracht Braunschweig GmbH & Co. KGaA, he/she must leave the stadium grounds.
(5) In the event of a justified expulsion in accordance with these stadium regulations, there is no entitlement to a refund of the admission fee already paid.
(6) For security purposes or in order to secure claims (for damages) by the organizer and/or third parties, the security and stewarding service is entitled to establish the identity of stadium visitors. In such cases, every stadium visitor is obliged to present his/her identification documents (identity card, passport, etc.) and/or other suitable identification documents at the request of the security staff. Persons who refuse to consent to an appropriate search or identity check may be prevented from entering the stadium.
(7) For events organized by BTSV Eintracht von 1895 e.V. or Eintracht Braunschweig GmbH & Co. KGaA, the following also applies: BTSV Eintracht von 1895 e.V. and Eintracht Braunschweig GmbH & Co. KGaA stand for an open-minded, tolerant sports and soccer culture and speak out against xenophobic, racist, homophobic, violence-glorifying, anti-Semitic, left-wing or right-wing extremist and xenophobic behavior, views on life and political attitudes. For this reason, persons whose external appearance gives the impression that they represent such behavior, views or political attitudes may be excluded from all events. External appearance includes, in particular, typical clothing with themed characters in which various numbers or letter combinations make the wearer's attitude clear or certain clothing brands that serve as a distinguishing feature for such an attitude (e.g. Thor Steinar or Consdaple). Furthermore, persons who express such behavior, views on life or political attitudes through flags, patches, propaganda material, calls or statements may be excluded from all events.
§ 5 Residence
(1) Only persons who have a valid admission ticket (e.g. day ticket or season ticket) or other proof of authorization (e.g. season ticket, day ticket, work card) or who can prove their right to stay for this event in another way are permitted to stay in the stadium during events. Admission tickets and proof of authorization must be carried within the stadium at all times and presented to the police or the security and stewarding service responsible for the respective event for inspection upon request.
(2) Spectators must take the seat indicated on the admission ticket for the respective event and use only the designated entrances on the way there.
(3) The admission ticket loses its validity when leaving the stadium grounds: this also applies to holders of annual or season tickets with regard to access authorization for the respective event day. The organizer may permit re-entry to the stadium grounds, in particular by means of technical facilities.
(4) It is generally not permitted to remain in the stadium on non-event days. The instructions issued by the City of Braunschweig and Braunschweiger Veranstaltungsstätten GmbH in agreement with the stadium users shall apply.
(5) Use of the parking areas:
(a) When entering the stadium and/or its facilities, visitors are obliged to show or provide proof of their parking or access authorization or other authorization to the security and stewarding service without being asked and to hand it over for inspection on request.
(b) Use of the parking areas is at the user's own risk. The organizer is not responsible for guarding, safekeeping or monitoring the vehicle or its contents or for providing vehicle-specific insurance cover.
(c) The opening hours vary and depend on the match schedule or event. Any notices or information must be observed by the visitor or user. There is no entitlement to compliance with specific opening times.
(d) Visitors must drive at walking pace. The instructions of the security and stewarding services as well as markings and signs must be followed. Vehicles may only be parked within the marked or allocated parking areas. In all other respects, the provisions of the StVO apply.
(e) Any stay in the parking area that is not related to the parking of a vehicle for the purpose of attending a game or event or the subsequent collection process is not permitted, unless the organizer has specified a separate purpose for the parking areas in the individual case of an event. Camping or cleaning and/or repairing vehicles is prohibited. This also applies to the parking of defective vehicles, the parking or storage of fuels, flammable objects of any kind and waste, honking, "engine warm-up" and other nuisances caused by avoidable exhaust fumes and noise.
(f) The organizer may have parked vehicles moved and/or removed at the expense and risk of the visitor and user of the parking area, in particular if (i) the authorization to use the parking area for the game or event has expired; (ii) a parked vehicle poses a danger due to a leaking tank or carburettor or other defects; (iii) a parked vehicle is not registered by the police or is taken out of circulation by the authorities; (iv) the vehicle has been parked without authorization, in particular on traffic areas or incorrect parking areas.
(g) The visitor and user of the parking area shall be liable for all damage culpably caused by himself or his accompanying persons to the organizer or third parties. This includes culpably caused soiling of the parking lot due to behavior that goes beyond the permitted public use. This includes in particular the depositing of garbage. (h) However, the organizer shall not be liable for damage caused by other visitors or other third parties. This applies in particular to damage to property, theft of valuables from the vehicle (e.g. car radio, telephone, personal valuables, computer, photographic equipment, sports equipment or similar) or items attached to or on the vehicle, insofar as the organizer is not at fault within the meaning of § 8 of these stadium regulations, which otherwise applies in addition.
§ 6 Behavior in the stadium
(1) Within the stadium grounds, every visitor must behave in such a way that neither other persons nor objects are harmed, endangered or - more than is unavoidable under the circumstances - hindered or inconvenienced. It is also forbidden to behave in a provocative manner that could lead to an altercation with other spectators.
(2) Visitors must follow the instructions of the police, the fire department, representatives and agents of the organizer, the security and public order service and the rescue service as well as the stadium announcer without restriction.
(3) For security reasons and to avert danger, visitors are obliged to take seats other than those indicated on their admission ticket - including in other blocks - or to leave the stadium and the adjacent outdoor areas if instructed to do so by the police, representatives and agents of the organizer or the security and stewarding service.
(4) All entrances and exits as well as the escape routes in the stadium and the entire stadium grounds must be kept clear at all times and without restriction.
(5) Notwithstanding these stadium regulations, authorized persons may issue further instructions as required in individual cases to prevent or eliminate danger to life, health or property. Instructions issued for this purpose must be complied with.
(6) Lost property: Any valuables found can be handed in at the Braunschweiger Veranstaltungsstätten GmbH office (Block 5) or at the Eintracht Braunschweig GmbH & Co KGaA office (fan store) during soccer events.
§ 7 Prohibitions
(1) Visitors to the stadium are prohibited from carrying the following items:
a) Objects, materials and/or media with racist, xenophobic, homophobic, violence-glorifying, anti-Semitic, discriminatory, xenophobic as well as right-wing and/or left-wing radical content; the same applies in particular to clothing (e.g. with lettering and/or symbols such as: Thor Steinar, Consdaple etc.), and/or body jewelry that contains lettering or symbols with clear racist, xenophobic, homophobic, violence-glorifying, anti-Semitic, discriminatory, xenophobic as well as right-wing and/or left-wing radical content.The same applies in particular to clothing (e.g. with lettering and/or symbols such as: Thor Steinar, Consdaple etc.), and/or body jewelry with lettering or symbols with a clear racist, xenophobic, homophobic, violence-glorifying, anti-Semitic, discriminatory, xenophobic and right-wing and/or left-wing radical tendency/content;
b) weapons or other dangerous objects of any kind that are capable of causing or causing injury (e.g. pocket knives, tools with knife blades, etc.);
c) objects that can be used as projectiles;
d) gas spray cans, corrosive, highly flammable, coloring or harmful solid, liquid or gaseous substances that are likely to cause injury or impairment to visitors
e) Bottles, cups, jugs, cans and other containers made of fragile, splintering or particularly hard material;
f) bulky objects such as ladders, stools, chairs, boxes, suitcases, large bags or other objects which by their nature are suitable or intended to cause injury to persons or damage to property. The carriage of baby carriages may be subject to special conditions imposed by the organizer and may be restricted to certain areas of the stadium; #
g) Fireworks, flares, torches, Bengal fires, smoke powder, smoke bombs, signal rockets and/or other pyrotechnic objects; sparklers;
h) Flag or banner poles and similar objects that are longer than 1.50 meters or have a diameter greater than 3 cm;
i) Mechanically, electrically or compressed air powered noise instruments;
j) Food & (especially alcoholic) drinks, unless purchased in the stadium
k) Narcotics within the meaning of the Narcotics Act;
l) Animals with the exception of assistance dogs;
m) Laser pointers;
n) Advertising or commercial objects of any kind and political and religious objects such as banners, signs, flyers or similar without the express permission of the organizer;
o) For safety reasons (keeping rescue and escape routes clear), medically necessary walking aids (crutches, rollators, etc.) may only be carried in the seating area and designated special areas. The stewarding and security service is entitled to assign a visitor who is carrying a walking aid an appropriate seat in accordance with Section 6 (3).
p) In agreement with the organizer and the police, individual visitors may be permitted to carry larger flags than those specified in § 7 No. 1h. The organizer also reserves the right, in agreement with the police, to make deviating individual arrangements with regard to large banners and/or megaphones/drums and other fan paraphernalia. The prerequisite for this is an application submitted in good time in advance by the visitors concerned to the organizer.
(2) Visitors are also prohibited from
a) utterances, gestures and/or an external appearance that are objectively suitable in nature and content to defame or injure third parties, in particular on the basis of skin color, religion, gender, sexual orientation, ancestry or This includes in particular the prohibition to express or disseminate racist, xenophobic, xenophobic, violence-glorifying, anti-Semitic as well as right-wing or left-wing radical slogans and to discriminate against population groups through statements, gestures or other behavior or to behave in any other racist and/or inhuman way;
b) Climbing or climbing over structures and facilities not intended for general use, in particular facades, fences, walls, enclosures of the playing area, barriers, lighting systems, camera platforms, trees, masts of all kinds and roofs;
c) to enter areas that are not permitted for visitors (e.g. the playing field, the interior, the function rooms);
d) throw objects of any kind, in particular not onto the sports fields or visitor areas; e) light fires, fireworks, flares, torches, Bengal fires, smoke powder, smoke bombs, signal rockets, sparklers and/or other pyrotechnic objects;
f) Without the permission of Braunschweiger Veranstaltungsstätten GmbH or the event organizer, to drive on the stadium grounds or paths or areas with vehicles or to park in an area not designated for the parking of vehicles without authorization; g) Without the permission of Stadthalle Braunschweig Betriebs-GmbH or the event organizer, to offer for sale and sell or offer goods, printed matter, in particular newspapers, magazines and admission tickets, as well as to distribute printed matter, advertising material or brochures or the like and to carry out collections.h) To label, paint or paste on, scratch, corrode or otherwise damage structural facilities, equipment or paths; i) To relieve oneself outside the toilets or to litter the stadium in any other way, in particular by throwing things away;
g) without the permission of Braunschweiger Veranstaltungsstätten GmbH or the event organizer, to offer for sale or sell goods, printed matter, in particular newspapers, magazines and tickets, as well as to distribute printed matter, advertising material or brochures or similar, and to carry out collections; h) to sell or offer for sale goods, printed matter, in particular newspapers, magazines and tickets, as well as to distribute printed matter, advertising material or brochures or similar. h) To label, paint or paste on, scratch, etch or otherwise damage structural facilities, equipment or paths; i) To relieve oneself outside the toilets or to litter the stadium in any other way, in particular by throwing things away;
j) Taking cameras and other image and sound recording devices, including video cameras, as well as the production of sound and image recordings of the event, their commercial distribution and the support of other persons in such activities, unless prior permission has been granted by Braunschweiger Veranstaltungsstätten GmbH or the respective event organizer;
k) To wear masks or carry objects that are suitable and, under the circumstances, intended to prevent identification;
l) Carrying and/or presenting (illegally obtained) fan articles/fan paraphernalia of any kind belonging to the opposing team, insofar as these are used to provoke other fan groups;
m) unfurling banners that obstruct the view with the purpose of concealing unauthorized actions;
(3) Smoking is prohibited in all publicly accessible and fully enclosed areas on the stadium grounds in accordance with §1 Para. 1 No. 8, No. 10 of the NIRSG.
§ 8 Liability
1) Entering and using the stadium and/or its facilities is at your own risk. The City of Braunschweig, Braunschweiger Veranstaltungsstätten GmbH, BTSV Eintracht von 1895 e.V. and Eintracht Braunschweig GmbH & Co. KGaA shall only be liable for damages resulting from injury to life, limb or health or in the cases provided for by mandatory law.
(2) The City of Braunschweig, Braunschweiger Veranstaltungsstätten GmbH, BTSV Eintracht von 1895 e.V. or Eintracht Braunschweig GmbH & Co. KGaA shall not be liable for personal injury or damage to property caused by third parties.
(3) Accidents and damage to property must be reported immediately to Braunschweiger Veranstaltungsstätten GmbH or BTSV Eintracht von 1895 e.V. or Eintracht Braunschweig GmbH & Co. KGaA or the organizer.
§ 9 Administrative offenses/violations
(1) Anyone who intentionally or negligently violates the prohibitions of § 7 within the stadium grounds, endangers or harms other persons through their behavior contrary to § 6, stays in the stadium without proof of residence authorization or does not occupy the specified space contrary to § 5 is in breach of the regulations within the meaning of § 10 para. 5 of the Lower Saxony Municipal Constitution Act.
(2) Anyone who violates the provisions of §§ 5 to 7 may be fined up to EUR 5,000.00 in accordance with the provisions of the German Administrative Offenses Act (OWIG), as amended. If a criminal offense or other administrative offense is suspected, a complaint may be filed.
(3) Persons who violate the provisions of the stadium regulations may be denied entry to the stadium and/or expelled from the stadium without compensation and without reimbursement of the admission fee, without prejudice to further rights of the organizer. The same applies to persons who are recognizably under the influence of alcohol or drugs.
(4) Persons whose behavior inside or outside the stadium in connection with an event impairs or endangers the safety and order of the event or violates the stadium regulations may be banned from the stadium or banned from the premises. This stadium ban/house ban may be limited to the stadium, taking into account the principle of proportionality, or may be imposed in consultation with the responsible national and international associations (e.g. DFB, DFL, UEFA, FIFA, GFL, DLV) or other operators of stadiums with nationwide or international effect.
(5) Prohibited items and/or objects will be seized and - insofar as they are not required for criminal investigation proceedings - returned after the conditions for seizure no longer apply against reimbursement of the costs incurred by the seizure and return or destroyed at the latest four weeks after the event at the expense of the visitor.
(6) Should the organizer be called upon by third parties to pay damages and/or fines as a result of improper conduct, these claims will be asserted against the perpetrators by way of recourse. The same applies to damage to property for which the perpetrator is responsible.
(7) The rights of the holder of domiciliary rights remain unaffected.
§ 10 Image and sound recordings
(1) Every visitor to an event at the stadium on Hamburger Straße agrees that the organizer is entitled to make image and sound recordings of the visitors and/or have them made by third parties, to reproduce, broadcast and use them without being obliged to pay any remuneration. These rights are valid for an unlimited period of time and worldwide.
(2) The stadium and - in some cases - the facilities are video-monitored to ensure stadium security and/or for security and law enforcement purposes.
